1. Subject matter and parties

These terms govern the use of the SIMONE PRO programme, a professional dermocosmetic hair analysis system comprising a mobile application, an AI-assisted analysis platform, two-level reporting and an evolutionary follow-up system (the “Programme”), provided by TRICHOMEDIC LABS, S.L.U., owner of the SIMONE TRICHOLOGY brand, with registered office in Spain (“TRICHOMEDIC”), to the professional establishment enrolling in the Programme (the “Establishment”).

Acceptance of these terms takes place in the application at the moment of sign-up; the accepted version, the Establishment’s identity and the timestamp are recorded.

2. Enrolment

Enrolment requires a sign-up code provided by an authorised SIMONE TRICHOLOGY distributor or by TRICHOMEDIC. The Establishment declares that it is a professional or company of the sector (hair salon, hair clinic or authorised technical point) and that the data provided at sign-up is accurate. Each enrolment corresponds to a single physical establishment and generates its own establishment code and credentials.

3. License

TRICHOMEDIC grants the Establishment a non-exclusive, non-transferable, non-sublicensable license to use the Programme, limited to the Establishment’s professional activity with its own clients and to the territory in which it operates. The license conveys no ownership of intellectual property or software.

4. Price, term and renewal

First year free. The license is free of charge for the first twelve (12) months from enrolment.

Renewal. Thereafter, the license renews for annual periods upon payment of two hundred and fifty euros (€250) per year, indirect taxes not included, through the application’s “Renew subscription” button or the channel TRICHOMEDIC enables.

Price changes apply only to future renewals and will be notified at least thirty (30) days before the renewal date.

Non-renewal. Upon expiry there is a thirty (30) day grace period. After it, the Programme will not allow new analyses; the Establishment retains read access to its case history and reports during the retention period agreed in the data protection Annex. Under no circumstances does non-renewal block the Establishment’s access to its own clients’ data.

5. Service content

The license includes: (i) hair analyses without limit in number, subject to fair use and a daily technical cap per establishment intended to prevent abuse or error; (ii) follow-ups at no cost, consuming no allowance; (iii) the technical and client reports (the latter co-branded with the Establishment); (iv) application and platform updates; and (v) reasonable technical support through the channels TRICHOMEDIC publishes.

6. Establishment obligations

The Establishment shall:

1. Use the Programme exclusively for professional purposes, in accordance with these terms and the documentation provided.
2. Collect each client’s informed consent through the application before any analysis, verifying the signatory’s identity and adult age.
3. Ensure the Programme is operated by staff with basic training in its use, and that every report is reviewed by the professional before delivery to the client.
4. Never hand or show the client the technical report or cabin material, which are for professional use only.
5. Always present the service as a cosmetic hair and scalp analysis, never as a medical diagnosis, and convey to the client any specialist referral indicated by the system.
6. Safeguard its credentials (code, PIN and authorised device) and report any unauthorised use without delay. The access key is bound to one device; use from other devices requires new authorisation.
7. Use the Programme with the compatible capture hardware indicated by TRICHOMEDIC and keep the optics calibrated as instructed by the application.
8. Not decompile, disassemble or reverse-engineer the Programme; not resell or lend it to third parties; not use it to provide services to other establishments.

7. Nature of the service and role of AI

The Programme provides a dermocosmetic, appearance-based analysis of hair and scalp. It is not a medical diagnosis and does not replace the assessment of a healthcare professional. Artificial intelligence assists the Establishment’s professional, whose judgement prevails in all cases: the output is a cosmetic recommendation that the professional reviews and delivers. Cases flagged for specialist referral must be conveyed to the client in those terms. The Establishment is responsible for its use of the reports and for the recommendations it conveys to its clients.

8. Data protection

The processing of the Establishment’s clients’ personal data is governed by the data processing agreement (Article 28 GDPR) that forms part of these terms as an Annex and is accepted in the same act. For that processing, the Establishment is the data controller and TRICHOMEDIC its processor. The Establishment’s own professional contact data is processed by TRICHOMEDIC as controller, for the management of the contractual relationship.

9. Intellectual and industrial property

The software, platform, algorithms, report templates, documentation and the SIMONE TRICHOLOGY and SIMONE PRO trademarks belong to TRICHOMEDIC or its licensors. Client data and cases generated by the Establishment belong to the Establishment-client relationship under the terms of the data protection Annex. TRICHOMEDIC may produce and use aggregated, anonymised Programme activity statistics.

10. Availability and support

TRICHOMEDIC will provide the service with due professional diligence, seeking maximum platform availability. Maintenance interruptions may occur and will preferably be scheduled outside usual business hours, with prior notice when planned and relevant. AI-assisted analysis depends on third-party technology providers; in the event of temporary unavailability of the analysis engine, cases are stored and processed when service is restored.

11. Warranties and liability

The Programme is provided “as is” within what is reasonable for a professional tool under continuous evolution. TRICHOMEDIC does not warrant that analysis results are infallible: quality also depends on capture (optics, calibration, framing) and on the data entered. TRICHOMEDIC’s total liability to the Establishment for any cause shall be limited to the amounts actually paid by the Establishment in the twelve (12) months preceding the triggering event, excluding loss of profit and indirect damages. Nothing herein limits liability that cannot legally be limited.

12. Suspension and termination

TRICHOMEDIC may suspend access in the event of material breach of these terms, fraudulent use or platform security risk, with prior notice where possible. The Establishment may withdraw at any time by notifying its distributor or TRICHOMEDIC. Upon termination, the data return and deletion regime of the data protection Annex applies.

13. Amendments

TRICHOMEDIC may publish new versions of these terms. The new version will be presented in the application and becomes enforceable upon the next renewal or, where changes so require, upon new acceptance in the app. Price changes are governed by Clause 4.

14. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute the parties submit to the competent Spanish courts, save for mandatory forum rules. The Spanish version of these terms prevails over its translations.
